Terms of Service

1. Eligibility

You must be at least 18 years old and legally able to enter binding contracts. Information supplied during registration must be accurate, current, and complete.

2. Account registration and verification

Bidding requires identity verification with a government-issued photo ID. Until approval, an account may be limited to browsing. You are responsible for your credentials and all activity under your account.

3. Auction rules and bidding

Every bid is a binding offer to buy. If you win, you must complete the purchase at the final bid amount plus applicable fees, taxes, and disclosed transport charges. Bids cannot be retracted after submission.

We may cancel, suspend, or correct an auction in the event of technical error, suspected fraud, incorrect lot data, or circumstances outside reasonable control.

4. Buy Now

When a Buy Now price is available, purchasing at that price ends the auction for that lot. Buy Now purchases carry the same payment and completion obligations as winning bids.

5. Fees and payment

The winning bidder is responsible for the hammer price plus a 0.5% auction fee and any applicable taxes, document costs, or transport fees. Full payment is due within 48 hours of auction close unless we confirm otherwise in writing.

Accepted methods may include wire transfer and approved electronic payments. Personal checks are not accepted.

6. Title transfer and pickup

Title transfers only after full payment clears. Cars Auction may facilitate paperwork and release instructions, but third-party carrier, lienholder, government, or courier delays remain outside our control.

7. User conduct

• No shill bidding, auction manipulation, or coordinated bidding abuse.
• No bots, scraping, credential sharing, or unauthorized access attempts.
• No redistribution of platform content without written permission.
• No conduct that interferes with other buyers or platform reliability.

8. Intellectual property

Lot photography, descriptions, logos, software, and interface design are owned by or licensed to CAR AUCTION USA LLC. You may not reproduce or create derivative works without prior written permission.

9. Liability and indemnification

To the maximum extent allowed by law, CAR AUCTION USA LLC, its officers, employees, and agents are not liable for indirect, incidental, consequential, or punitive damages arising from platform use or vehicle purchase.

You agree to indemnify CAR AUCTION USA LLC against claims arising from your use of the platform, breach of these terms, or violation of third-party rights.

10. Governing law and updates

These terms are governed by Florida law. Material changes may be communicated by email or platform notice. Continued use after the effective date means acceptance of the revised terms.
